Petboost AI Agent: Terms of Use & Disclaimer

Petboost AI Agent is an AI-powered assistant built into the Petboost platform. It can look up information about your customers, pets, appointments, services and business settings to help you find answers quickly. It is a helpful tool, but it is not a substitute for your own judgement or professional advice.
AI can and does make mistakes. While we work hard to make it accurate and reliable, you should always double-check anything the AI Agent tells you before acting on it. It does not provide financial, legal, veterinary, tax or business advice.
By choosing to use Petboost AI Agent, you are opting in to these terms. You can stop using it at any time.
These terms ("AI Agent Terms") are supplementary to and form part of the Petboost Site Terms & Conditions and the Business Experience Terms. To the extent of any inconsistency between these AI Agent Terms and the general Terms & Conditions, these AI Agent Terms prevail in relation to your use of the Petboost AI Agent. Defined terms used in these AI Agent Terms have the same meaning as in the general Terms & Conditions unless otherwise defined here.
Please read these terms carefully before using Petboost AI Agent. By activating, accessing or using the AI Agent, you acknowledge that you have read, understood and agree to be bound by these AI Agent Terms.
1. Introduction and Scope
These AI Agent Terms govern your use of Petboost AI Agent ("AI Agent"), an artificial intelligence-powered assistant feature available within the Petboost Platform operated by Petboost Proprietary Limited, ABN 46 640 246 279 ("Petboost", "we", "us" or "our").
The AI Agent is an optional feature. You are not required to use it, and your access to the broader Petboost Platform is not conditional on your use of the AI Agent.
These terms apply to all Members who access or use the AI Agent, including business owners, administrators and authorised team members ("you" or "your").
2. What Petboost AI Agent Is
Petboost AI Agent is an AI-powered assistant that uses large language model (LLM) technology to help you retrieve and interpret information stored within your Petboost account. The AI Agent may:
- Look up customer, pet, appointment, service, team member and resource information within your business data.
- Summarise or present information from your business dashboard, settings and operational data.
- Suggest next steps, surface relevant context or highlight items that may need your attention.
- Answer questions about how Petboost features work by searching documentation.
The AI Agent is a read-only informational tool. It does not create, modify, delete or execute any actions on your behalf. It cannot make bookings, process payments, cancel appointments, send communications or make changes to your business settings or data. Any action you take based on information from the AI Agent is your own decision and responsibility.
3. Not Professional Advice
Important: Please read this section carefully.
Petboost AI Agent does not provide, and must not be relied upon as a substitute for, professional advice of any kind. Specifically, the AI Agent does not provide:
- Financial advice (including accounting, tax planning, revenue forecasting or investment advice)
- Legal advice (including advice on contracts, compliance, employment law or regulatory obligations)
- Business advice (including strategic planning, operational recommendations or commercial decision-making)
- Veterinary or animal health advice (including diagnoses, treatment recommendations or medication guidance)
- Tax advice (including BAS obligations, GST calculations, deductions or reporting guidance)
- Employment or workplace advice (including staffing decisions, rostering compliance or industrial relations)
While the AI Agent may present information that touches on these areas (for example, displaying revenue figures from your dashboard, or summarising appointment patterns), this information is presented for your convenience only and does not constitute formal or professional advice.
You must consult appropriately qualified professionals (such as accountants, lawyers, veterinarians, financial advisers or business consultants) before making decisions in these areas. Petboost is not a professional advisory firm and does not hold itself out as one.
Any recommendations, suggestions or insights provided by the AI Agent are general in nature, are not tailored to your specific circumstances and should be treated as a starting point for your own independent assessment, not as a conclusion or direction to act.
4. Accuracy and Reliability
The AI Agent uses artificial intelligence technology, including large language models provided by third-party services. By its nature, AI-generated content:
- May contain errors, inaccuracies or omissions. AI models can misinterpret data, produce incorrect calculations, present outdated information or generate responses that appear plausible but are factually wrong (sometimes called "hallucinations").
- May not reflect the most current state of your data. There may be brief delays between when data is updated in your account and when the AI Agent reflects those changes.
- May vary between interactions. The same question may produce different responses at different times due to the probabilistic nature of AI models.
- May misunderstand context or intent. The AI Agent may misinterpret your question, provide information about the wrong customer or pet, or draw incorrect connections between data points.
You must independently verify all information provided by the AI Agent before relying on it or taking action. This includes verifying customer details, appointment information, financial figures, dates, times and any other data presented. The AI Agent is a convenience tool to help you navigate your data more quickly; it is not a source of truth.
Petboost does not warrant or represent that AI Agent outputs will be accurate, complete, current, reliable or error-free.
5. Your Responsibilities
By using the AI Agent, you acknowledge and agree that:
- You are solely responsible for all decisions you make, actions you take and outcomes that result from your use of the AI Agent or reliance on its outputs.
- You will verify all AI Agent outputs against your own records and professional judgement before acting on them.
- You will not rely on the AI Agent as your sole basis for any decision that could have financial, legal, health, safety or other material consequences for you, your business, your customers, their pets or any third party.
- You will use the AI Agent lawfully and in accordance with these AI Agent Terms, the general Terms & Conditions and all applicable laws and regulations.
- You will not attempt to misuse the AI Agent, including but not limited to: attempting to extract data you are not authorised to access; using automated tools to interact with the AI Agent; attempting to manipulate, reverse-engineer or circumvent any safeguards; or using the AI Agent to generate misleading, harmful or unlawful content.
- You are responsible for ensuring that your team members who have access to the AI Agent understand and comply with these AI Agent Terms. As a business owner or administrator, the use of the AI Agent by your authorised users is subject to these terms and you accept responsibility for their compliance.
6. Data and Privacy
6.1 What Data the AI Agent Accesses
When you interact with the AI Agent, it may access the following data within your Petboost account in order to respond to your queries:
- Customer and pet owner profiles (names, contact details, account status)
- Pet profiles (names, breeds, ages, weights, service eligibility, medical or behavioural notes recorded by the business)
- Appointment records (dates, times, statuses, services, activity logs)
- Service listings, pricing and business settings
- Team member details and resource information
- Business dashboard summaries, including financial summaries
- Payment method information (limited to card type and last four digits only; full card numbers are never accessed or displayed)
- Booking availability and eligibility information
6.2 How Your Data Is Processed
To generate responses, the AI Agent sends relevant portions of your data to third-party AI model providers (currently Microsoft Azure AI services). This processing is subject to the following:
- Data is transmitted securely using encrypted connections.
- Data is sent only as needed to respond to your specific query and is not stored by the AI model provider for training or other purposes beyond providing the response.
- Petboost selects AI model providers that offer enterprise-grade data protection commitments. As at the date of these terms, Azure AI services are deployed under Microsoft's data processing terms, which include commitments not to use customer data to train or improve foundation models.
- Petboost may change AI model providers from time to time. We will ensure that any replacement provider offers comparable data protection standards.
6.3 Contextual Data
In addition to your business data, the AI Agent may receive contextual information to improve its responses, including:
- Your current page location within the Petboost app
- The date you are currently viewing (for example, on the scheduler)
- Your recent navigation history within the current session
- Your business timezone
This contextual data is used solely to provide more relevant and accurate responses and is not stored beyond the duration of your session.
6.4 Observability and Improvement
Petboost may collect anonymised usage data about AI Agent interactions (such as response times, error rates and token usage) for the purpose of monitoring performance, identifying issues and improving the service. This data does not include personally identifiable information or the content of your queries or responses.
6.5 Your Obligations Regarding Customer Data
You acknowledge that using the AI Agent involves processing personal information of your customers and their pets. You are responsible for:
- Ensuring that your collection and use of customer data complies with the Privacy Act 1988 (Cth), the Australian Privacy Principles and any other applicable privacy legislation.
- Having appropriate privacy notices and consents in place with your customers regarding how their data may be processed, including through AI-powered features.
- Handling customer data accessed through the AI Agent in accordance with Schedule N (Data Management Policy) of the Business Experience Terms.
7. Experimental Status
Petboost AI Agent is currently designated as an experimental feature.
This means it is under active development and may not perform as expected in all situations. We are continuously testing, improving and adding safeguards, but you should exercise additional caution when using experimental features.
As an experimental feature, the AI Agent:
- May have bugs, produce unexpected results or behave inconsistently.
- May be updated, modified, suspended or withdrawn at any time without prior notice.
- May have its capabilities expanded or reduced as we learn from usage and feedback.
- Is provided on an "as is" and "as available" basis without any warranty of any kind, whether express or implied.
The experimental designation may be removed in future when we consider the feature to be sufficiently stable and reliable. Even after the experimental designation is removed, these AI Agent Terms (including all disclaimers and limitations) will continue to apply.
8. Opt-In and Consent
8.1 Affirmative Opt-In Required
Use of the AI Agent requires your affirmative opt-in. You will be asked to confirm your acceptance of these AI Agent Terms before you can access the AI Agent for the first time. Only account owners and administrators can provide this consent on behalf of a business.
8.2 Continuing Consent
Your continued use of the AI Agent after opting in constitutes your ongoing consent to these AI Agent Terms, including any updates we may make to them. We will notify you of material changes and may require you to re-confirm your acceptance.
8.3 Withdrawal of Consent
You may stop using the AI Agent at any time. If you wish to formally withdraw your consent and have the AI Agent deactivated for your account, please contact us at help@petboost.com.au. Withdrawal of consent does not affect the lawfulness of any processing carried out prior to your withdrawal.
8.4 Record of Acceptance
When you opt in, Petboost will record the name of the person accepting these terms, the date and time of acceptance and the version of these AI Agent Terms accepted. This record is maintained for audit and compliance purposes.
9. Limitation of Liability
9.1 Disclaimer of Warranties
To the maximum extent permitted by law, the AI Agent is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness and non-infringement.
Petboost does not warrant that the AI Agent will be uninterrupted, error-free, accurate, reliable or meet your expectations or requirements. Petboost does not warrant or guarantee any specific outcome from your use of the AI Agent.
9.2 Exclusion of Liability
To the maximum extent permitted by law, Petboost, its directors, officers, employees, agents, contractors and affiliates shall not be liable to you or any third party for any:
- Loss or damage arising from your use of, reliance on or inability to use the AI Agent or its outputs.
- Indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill or anticipated savings, whether or not Petboost has been advised of the possibility of such damages.
- Errors, inaccuracies, omissions or misleading information in AI Agent outputs.
- Decisions made or actions taken by you based on AI Agent outputs.
- Any failure or delay in the AI Agent's performance.
9.3 Cap on Liability
To the extent that Petboost's liability cannot be excluded under applicable law (including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law), Petboost's total aggregate liability to you for all claims arising out of or related to the AI Agent shall be limited to the lesser of: (a) the amount of Platform Fees you paid to Petboost in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred Australian dollars (AUD $100).
9.4 Consumer Law Protections
Nothing in these AI Agent Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement. If the Australian Consumer Law or any other applicable law implies a condition, warranty or guarantee that cannot be excluded, then to the extent permitted by law, Petboost limits its liability for breach of that implied condition, warranty or guarantee to (at Petboost's election): (a) re-supply of the relevant service; or (b) payment of the cost of having the relevant service re-supplied.
10. Indemnification
You agree to indemnify, defend and hold harmless Petboost, its directors, officers, employees, agents, contractors and affiliates from and against any and all claims, demands, actions, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of, or reliance on, the AI Agent or its outputs.
- Any decision made or action taken by you based on information provided by the AI Agent.
- Your breach of these AI Agent Terms.
- Your violation of any applicable law or regulation in connection with your use of the AI Agent.
- Any claim by a third party (including your customers) arising from your use of the AI Agent or reliance on its outputs.
11. Changes and Discontinuation
11.1 Changes to the AI Agent
Petboost reserves the right to modify, update, enhance, limit or discontinue the AI Agent (or any part of it) at any time, with or without notice, and without liability to you. This includes changes to the AI models used, the data accessible to the AI Agent, the features available and the manner in which the AI Agent operates.
11.2 Changes to These Terms
Petboost may amend these AI Agent Terms at any time. We will use reasonable efforts to notify you of material changes (for example, by notice within the Petboost Platform or by email). Your continued use of the AI Agent after the effective date of any changes constitutes your acceptance of the amended terms. If you do not agree with the changes, you should stop using the AI Agent.
11.3 Discontinuation
If Petboost discontinues the AI Agent, we will provide reasonable notice where practicable. You will not be entitled to any compensation, refund or damages as a result of the discontinuation of the AI Agent.
12. Governing Law
These AI Agent Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia sitting in New South Wales, and any courts of appeal from those courts, for the purposes of hearing and determining any dispute arising out of or in connection with these AI Agent Terms.
If any provision of these AI Agent Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
